The General Office of the Ministry of Industry and Information Technology recently issued a notice clarifying the contents of rectifying the illegal and irregular behavior of rare earth mineral products under the name of “resource utilization”.

According to the notice, since September 30, 2014, the Ministry of Industry and Information Technology, together with the Ministry of Public Security and the Ministry of Land and Resources, jointly issued the "Letters on Organizing and Conducting Special Actions to Combat Rare Earth Illegal Activities," and related local authorities have actively carried out rectification work and investigated and dealt with it. Approval of illegal and irregular cases has promoted the improvement of rare earth production and circulation. However, the act of illegally processing rare earth minerals in the name of “resources comprehensive utilization” still exists in large quantities, resulting in oversupply in the rare earth market, and the price of products continues to fall. In response to the major problems, the Ministry of Industry and Information Technology decided to organize special inspection and rectification work.

The notice made it clear that the content of this rectification is to comprehensively check and rectify the comprehensive use of rare earth resources in the Southern Province (region), which will be conducted in two phases. In the first phase, from November 1 to November 20, local industrial authorities and the China Rare Earth Industry Association organized technical personnel to visit the company's site to check the source of raw materials, production status, etc., and requested the company to provide the necessary certification materials and complete the questionnaire. In the second stage, from November 21 to December 20, the inspection found that suspected illegal and irregular processing of rare earth mineral products, the Ministry of Industry and Information issued a list of inspection companies, local industry authorities inspected the source of mineral products, the acquisition of illegal rare earth mineral products , Illegal mineral products, tank bottom materials and illegal income shall be confiscated according to law and be punished; For acquisition of illegal rare earth mineral products and failure to explain the origin of mineral products, enterprises are required to provide sufficient payment certificates for the rare earth mineral resources tax, which cannot be provided by the taxation department; Any person suspected of constituting a crime who needs to be investigated for criminal responsibility in accordance with the law shall be transferred to the public security organ for investigation and investigation in accordance with the "Regulations on the Transfer of a Case of Suspected Crime by an Administrative Law Enforcement Authority."

The notice requires that all local industrial administrations should do a good job in organizing the company's on-site inspections, send special personnel to participate in inspections, and require the company to provide a detailed list of sources of raw materials and bill proofs. After the results of inspections are issued, local governments are required to carefully organize inspections of the enterprises in question to find out the sources and quantities of raw materials, investigate and punish those enterprises that are involved in the business of buying, selling and processing illegal mineral products, and investigate them in relevant news media in the province (district). exposure.
